We are Allê by April, and by using this website, you agree to be legally bound by our Terms and Conditions and by all other applicable provisions. We may update and amend our terms once in awhile therefore please make sure you have an up to date copy of these terms before you place an order with us. If you do not wish to accept any new terms and conditions after we have given notice, we suggest that you discontinue to use this Website.
- DEFINITIONS AND INTERPRETATIONS
Reference to ‘you’ is a reference to the customer
“Contract” means the contract between us for the sale and purchase of the Goods that incorporates these T’s & C’s.
“Goods” means the shoes and other items purchased by you from us.
- PRICE
3.1 Prices include VAT (where applicable).
Depending on the value of your order or the delivery option or address you choose; delivery costs may also be charged. Such additional charges will be clearly shown during the checkout process and included in the ‘Total Cost’. Please note that you will be responsible for any local taxes and/or duty on your incoming purchase.
3.2 All published prices are subject to change at any time without notice.
- ORDERING GOODS ONLINE
4.1 You warrant to us that all information which you are required to provide when ordering Goods online is accurate and complete in all respects at the time of the order
4.2 When an order is made online, the order confirmation issued by the company clearing the credit/debit card payment does not constitute acceptance of your order by us. We reserve the right to check any discrepancies and an order will only be confirmed when it is verified by us.
4.3 Any error in any ordering process due to technical or other reasons beyond our control entitles us to treat the order as NOT being binding on us.

- PAYMENT
6.1 All payments for Goods and for the cost of packaging and delivery where applicable must be made before the Goods are dispatched.
6.2 Payment online will be made by credit or debit card or Paystack where allowed, as well as bank transfers. We do not accept payment by cheque or other means. In all cases, delivery will not occur until we are satisfied that the payment has been made.

- DELIVERY
7.1 We will give you an estimated delivery date for the Goods but no times or dates provided by us are guaranteed.

- CANCELLATION

- RISK AND OWNERSHIP
9.1 The risk of loss or damage to Goods passes to you upon delivery. If you have agreed to collect the Goods from us, the risk in those Goods passes to you on collection.
9.2 Ownership in all Goods remains with us until full payment of all amounts due to us has been received from you.
9.3 In the case on Returns in transit back to us, on the basis of refund & exchange, you will be responsible for the safety and insurance of the merchandise to our door step. Please refer to the “Returns and Refund Policy” herein.
- NOTICES
10.1 If you wish to give us any notice relating to a matter covered by these T’s and C’s, we recommend that you notify us in writing. In the case of email notices, kindly write to us at hello@allebyapril.com, after which, we Return with an acknowledgement of receipt.
- CUSTOMER DEFAULT
If in the case of incorrect personal information given, or failure to make payments when due, or cancelation of any payment, or become insolvent, or commit any breach of these terms and policies, we reserve the right to cancel our contract with you, or recover possession of any goods which have been supplied for which payment has not been received in full, depending on its gravity.
- ENTIRE AGREEMENT:
These Terms govern our relationship with you and in accepting them, you confirm that no other arrangement, agreement or representation applies.
- GOVERNING LAW / DISPUTE RESOLUTION
The Contract shall be governed by Nigerian law and any and all disputes arising out of or in connection with the contract shall be finally settled under the Rules of Arbitration of the Lagos Multi-door Court by one or more arbitrators appointed in accordance with the said Rules.
AllêbyApril reserves the right to amend these Terms & Conditions from time to time where we consider it reasonable and necessary to do so.
